ឧទ្យានជាតិភ្នំព្រះវិហារ ( ថៃ: อุทยานแห่งชาติเขาพระวิหาร ) គឺជាតំបន់ការពារធម្មជាតិក្នុងខេត្តស៊ីសាកេត ប្រទេសថៃ ដែលមានប្រាសាទបុរាណ ជាច្រើននៃអាណាចក្រខ្មែរ សតវត្សរ៍ទី១១។ ឧទ្យាននេះ 98 kiloម៉ែត្រs (61 mi) ខាងត្បូង ក្រុងស៊ីសាកេត នៅចុង ផ្លូវជាតិថៃលេខ ២២១ ។ ស្ថិតនៅលើច្រាំងថ្មក្រហម ដែលជាផ្នែកមួយនៃជួរភ្នំដងរែក នៅគែមខាងត្បូងនៃខ្ពង់រាបគោរាជ វាស្ថិតនៅជាប់ព្រំដែនអន្តរជាតិ រវាង ខេត្តស៊ីសាកេត របស់ប្រទេសថៃ និង ខេត្តព្រះវិហារ របស់ប្រទេសកម្ពុជា ។ ឈ្មោះនៃច្រាំងថ្មចោទនៅក្នុង ប្រព័ន្ធប្រតិចារិកទូទៅរបស់រាជថៃ គឺ ផាម៉ូអ៊ីដែង ( ผามออีแดง ) ឧទ្យាននេះត្រូវបានបង្កើតឡើងនៅថ្ងៃទី ២០ ខែមីនា ឆ្នាំ ១៩៩៨ ដែលមានផ្ទៃដី 81,250 រ៉ៃ ~ 130 square kilometres (50 sq mi) ។ ^[១]

ច្រកចូលប្រាសាទព្រះវិហារ

ឧទ្យាននៅលើផាម៉ូអ៊ីដែង គឺជាច្រកទ្វាររបស់ថៃទៅកាន់ ប្រាសាទព្រះវិហារ ហើយជាទូទៅត្រូវបានបើកសម្រាប់មនុស្សគ្រប់គ្នានៅពេលបង់ថ្លៃចូល។ នៅពេលដែលទំនាក់ទំនងរវាងប្រទេសទាំងពីរមានលក្ខណៈធម្មតា ប្រាសាទព្រះវិហារក៏អាចចូលបានពីភាគីថៃផងដែរ។ ភាគីទាំងពីរគិតថ្លៃចូលបន្ថែមសម្រាប់ការចូលបែបនេះ ប៉ុន្តែកម្ពុជាមិនតម្រូវឱ្យមានទិដ្ឋាការ ទេ។ ច្រកចេញចូលពីខាងកម្ពុជាគឺចូលប្រាសាទតែប៉ុណ្ណោះ។ តុលាការយុត្តិធម៌អន្តរជាតិ បានសម្រេចប្រគល់ប្រាសាទព្រះវិហារទៅឲ្យប្រទេសកម្ពុជា ក្នុងឆ្នាំ ១៩៦២ ^[២] ប៉ុន្តែប្រាសាទទាំងនោះស្ថិតនៅក្នុងផ្ទៃដី ៤,៦ គីឡូម៉ែត្រការ៉េ ដែលថៃនៅតែទាមទារ។ ^[៣] យ៉ាងណាក៏ដោយ ក្នុងឆ្នាំ ២០០៨ សម័យប្រជុំលើកទី ៣២ របស់គណៈកម្មាធិការបេតិកភណ្ឌពិភពលោក បានចុះបញ្ជីប្រាសាទព្រះវិហារជា សម្បត្តិបេតិកភណ្ឌពិភពលោក របស់អង្គការយូណេស្កូ ^[៤] ដែលបានជំរុញឲ្យមានជម្លោះប្រដាប់អាវុធ។

សម្រាប់សុវត្ថិភាពរបស់អ្នកទស្សនា តំបន់ដែលមាន មីន ត្រូវបានសម្គាល់យ៉ាងច្បាស់។

វិវាទ

ក្នុងឆ្នាំ២០០៧ កម្ពុជា បានស្នើទៅសម័យប្រជុំសាមសិបដំបូងរបស់គណៈកម្មាធិការបេតិកភណ្ឌពិភពលោក ដែលប្រាសាទព្រះវិហារត្រូវចុះក្នុងបញ្ជី បេតិកភណ្ឌពិភពលោករបស់អង្គការយូណេស្កូ ។ ដោយសារកម្ពុជា និងថៃមិនទាន់បានដោះស្រាយបញ្ហាព្រំដែនពាក់ព័ន្ធនឹងទីតាំងនោះ គណៈកម្មាធិការបានពន្យារពេលការពិចារណាទៅសម័យប្រជុំលើកទី ៣២ ហើយបានស្នើឱ្យកម្ពុជាផ្តល់ផែនការគ្រប់គ្រងពេញលេញសម្រាប់តំបន់នោះ។ នៅដើមខែមករា ឆ្នាំ២០០៨ កម្ពុជាបានអញ្ជើញអ្នកជំនាញថៃឱ្យចូលរួមក្នុងការស្ទង់មតិ តំបន់ទ្រទាប់ (Buffer Zone) ហើយបន្ទាប់មកទៅកាន់ ខេត្តសៀមរាប និង រាជធានីភ្នំពេញ ដើម្បីសហការជាមួយក្រុមអ្នកជំនាញអន្តរជាតិក្នុងការបង្កើតផែនការសម្រាប់តំបន់នៅក្នុងទឹកដីកម្ពុជា។ អ្នកជំនាញថៃបានរកឃើញ "ភាពមិនត្រឹមត្រូវខាងវិទ្យាសាស្ត្រដែលមិនអាចទទួលយកបាន" នៅក្នុងឯកសារដែលបានបង្ហាញ ផ្តាច់ខ្លួនចេញពីក្រុម ហើយបន្ទាប់មកបានបោះពុម្ពផ្សាយដោយបដិសេធ ផែនការគ្រប់គ្រងរបស់ពួកគេផ្ទាល់សម្រាប់ភ្នំព្រះវិហារ និងការកំណត់របស់វា។ កំណែជាភាសាអង់គ្លេសជា PDF នៃផែនការត្រូវបានចេញផ្សាយ។ ^[៥]

បន្ទាប់ពីមានការស្នើសុំកាលពីខែកុម្ភៈ ឆ្នាំ ២០១១ ពីប្រទេសកម្ពុជា ឱ្យបញ្ជាឱ្យកងកម្លាំងយោធាថៃចេញពីតំបន់នោះ ចៅក្រមនៃតុលាការអន្តរជាតិដោយសំឡេង ១១ – ៥ បានបញ្ជាឱ្យប្រទេស ទាំងពីរ ដកកងកម្លាំងយោធារបស់ពួកគេជាបន្ទាន់ ហើយដាក់កម្រិតបន្ថែមលើកងកម្លាំងប៉ូលីសរបស់ពួកគេ។ តុលាការបាននិយាយថា សេចក្តីសម្រេចរបស់ខ្លួននឹងមិនកាត់សេចក្តីសម្រេចចុងក្រោយណាមួយអំពីកន្លែងដែលព្រំដែនក្នុងតំបន់រវាងប្រទេសថៃ និងកម្ពុជាគួរធ្លាក់ចុះ។ វាអាចចំណាយពេលច្រើនខែ ឬច្រើនឆ្នាំដើម្បីសម្រេចសេចក្តីសម្រេចរបស់តុលាការ។ ^[៦] អភិសិទ្ធិ វេជ្ជាជីវ (នាយករដ្ឋមន្ត្រីរង់ចាំ ចាប់តាំងពី ការបោះឆ្នោតសកលឆ្នាំ២០១១ របស់ថៃ ដែលទើបនឹងបញ្ចប់) បាននិយាយថា ទាហានថៃនឹងមិនដកខ្លួនចេញពីតំបន់ជម្លោះនោះទេ រហូតដល់យោធានៃប្រទេសទាំងពីរយល់ព្រមលើការដកខ្លួនទៅវិញទៅមក។ លោកបានមានប្រសាសន៍ថា “ខ្ញុំមិនអាស្រ័យលើភាគីទាំងពីរក្នុងការមកជួបជុំគ្នានិងជជែកគ្នានោះទេ” ដោយលោកបានស្នើថា គណៈកម្មាធិការព្រំដែនរួមដែលមានស្រាប់នឹងជាកន្លែងដ៏ស័ក្តិសមក្នុងការរៀបចំផែនការដកការសម្របសម្រួល។ ^[៧]
